1. Introduction
These Terms of Service (“Terms”) govern your access to and use of the website located at https://innovative.org.za/ (the “Site”) and any programs, training hubs, events, initiatives, volunteer opportunities, donations, or related services offered by Innovative Entrepreneurs NPC (“Innovative,” “we,” “us,” or “our”).
By accessing the Site or participating in any of our services, you agree to be bound by these Terms. If you do not agree, you must not use the Site or participate in our programs.
2. About Innovative Entrepreneurs NPC

We are focused on inclusive entrepreneurship, socio-economic development, skills training, and market access initiatives. Nothing in these Terms creates a partnership, agency, or employment relationship between you and Innovative unless expressly agreed in writing.
3. Use of the Website
You agree to use the Site only for lawful purposes and not to:
Upload harmful or unlawful content
Attempt to gain unauthorized access to systems
Disrupt or interfere with website functionality
Misrepresent your identity
We reserve the right to restrict or terminate access for violations.
4. Program Participation
Innovative operates training hubs, workshops, seminars, mentorship programs, and development initiatives.
By participating, you agree that:
Participation is voluntary
You are responsible for your own decisions and actions
You will comply with program rules and codes of conduct
You will treat staff, volunteers, and other participants respectfully
Innovative reserves the right to suspend or remove participants for misconduct. Certain programs or activities may require event-specific waivers, which form part of your agreement to participate.
5. Volunteer & Internship Participation
Volunteers and interns acknowledge that:
Participation does not create an employment relationship
No wages or benefits are implied unless expressly agreed
Confidential information accessed during service must not be disclosed
Separate Volunteer or Internship Agreements apply and govern responsibilities and obligations
6. Donations
If you make a donation:
Donations are voluntary
Donations are non-refundable unless required by law
Innovative may allocate funds at its discretion to further its mission
Tax deductibility (if applicable) is subject to South African tax law
7. Intellectual Property
All materials on the Site and within programs — including training materials, logos, research, content, and publications — are owned by or licensed to Innovative.
You may not:
Reproduce materials for commercial purposes
Modify or distribute content without permission
Represent Innovative materials as your own
Participants may use educational materials for personal development only.
8. Confidentiality & NDAs
Users acknowledge that:
Certain programs and projects involve confidential information
Separate Non-Disclosure Agreements (NDAs) may apply for partners, funders, or participants
Disclosure of confidential information is prohibited without consent
9. Collection and Use of Personal Information
Innovative processes personal information in accordance with the Protection of Personal Information Act, 4 of 2013 (POPIA) and our Privacy Policy (Link in footer).
Personal information may be collected for:
Program administration and event registration
Communication about initiatives
Volunteer and internship management
Donations and fundraising
Legal compliance
Participants under 18 must provide parental or guardian consent; their personal data is handled under our Safeguarding Policy (Section 20).
10. Media & Publicity Consent
By participating in programs or events, you acknowledge that photographs or video recordings may be taken. Unless you notify us in writing, you grant Innovative permission to use such media for promotional, reporting, or educational purposes.
11. Third-Party Partners
Innovative collaborates with public and private sector partners. We are not responsible for the independent actions, services, or representations of third-party partners unless expressly stated.
12. Event Participation & Waivers
Certain programs, workshops, or physical activities may require participants to sign waivers acknowledging risks. These waivers are legally binding and form part of your agreement to participate.
13. Disclaimer of Warranties
The Site and services are provided “as is” and “as available.”
We do not guarantee:
Uninterrupted access
Accuracy or completeness of content
Guaranteed outcomes from participation
Participation does not guarantee funding, employment, market access, or business success.
14. Force Majeure
Innovative shall not be liable for failure or delay in performance due to causes beyond reasonable control, including natural disasters, government actions, power outages, or public emergencies.
15. Limitation of Personal Liability
No director, trustee, employee, volunteer, or representative of Innovative shall be personally liable for obligations of the organization.
16. Dispute Resolution
Any dispute arising from these Terms shall first be addressed through good faith negotiation. If unresolved, the matter may be submitted to mediation and, failing resolution, to binding arbitration in the Republic of South Africa.
17. Governing Law
These Terms are governed by the laws of the Republic of South Africa.

19. Changes to Terms
We may update these Terms periodically. Continued use of the Site or participation in programs after updates constitutes acceptance of revised Terms.

20. Safeguarding Policy (Child Protection)
Innovative Entrepreneurs NPC is committed to the safety, well-being, and protection of minors (any participant under 18 years of age) in all programs, events, and activities. This Safeguarding Policy applies to all staff, volunteers, interns, contractors, partners, and participants.
20.1 Scope
Covers all activities where minors may participate, including workshops, mentorship programs, events, and hubs.
Applies to all personnel involved in program delivery.
20.2 Parental / Guardian Consent
Minors must have written consent from a parent or legal guardian before participating.
Consent forms must be completed and returned before participation.
Parents/guardians have the right to withdraw consent at any time.
20.3 Safe Environment
All activities will be conducted in a safe and supervised environment.
Staff and volunteers undergo background checks or screening appropriate for working with minors.
Innovative will implement measures to prevent abuse, neglect, or exploitation.
20.4 Code of Conduct
All staff, volunteers, interns, and partners must adhere to a strict code of conduct with minors, including:
Treating minors with respect and fairness
Avoiding inappropriate physical or verbal contact
Reporting any concerns or breaches immediately
20.5 Reporting Concerns
Any suspected abuse, neglect, or policy violation must be reported immediately to:

20.6 Data Protection for Minors
Personal information of minors is collected only with parental or guardian consent.
Data is processed in accordance with POPIA and our Privacy Policy, with additional safeguards for minors.
20.7 Training & Awareness
Staff, volunteers, and contractors receive training on child protection, safeguarding, and reporting procedures.
Parents/guardians will be informed of safeguarding practices relevant to programs their child participates in.
20.8 Enforcement
Breaches of this policy may result in removal from programs, termination of volunteer or staff engagement, and potential legal action.
Innovative reserves the right to take any necessary measures to protect minors.
